TERMS OF SALES

 

GENERAL CONDITIONS OF SALE FOR THE  “AVERAGE PUBLIC”

 

1.1 General

These general conditions of sale apply to all sales transactions concluded by the Réserve des Monts d’Azur.

Depending on the type of product sold, special conditions apply.

The Monts d’Azur Biological Reserve sells:

– Tickets for access to the Réserve
– Catering and accommodation
– By-products
– Packages, according to article 2, law of July 13, 1992

These general conditions and the special conditions applicable, depending to the product sold, are an integral part of the sales contract.

 

1.2 Capacity

Any customer of the Monts d’Azur Reserve acknowledges having the capacity to adhere to the conditions described in the general conditions of sale presented below, that is to say to be of legal age and not to be under guardianship or curatorship.

Any client of the Réserve des Monts d’Azur acknowledges having read the conditions of sale before placing their order.

Any customer of the Monts d’Azur Reserve acknowledges having read the internal regulations and security conditions before entering the Monts d’Azur Reserve.

Therefore, ordering or purchasing tickets entails its full adherence to the general and specific conditions of sale of the Réserve des Monts d’Azur and its unreserved acceptance of all their measures.

 

1.3 Display of prices

All prices are displayed in Euros. The tax (VAT) is always included.

 

1.3.1: Safari by horse-drawn carriage or on foot:

Our horse-drawn carriage or walking safari rates include a visit lasting one hour and fifteen minutes for the horse-drawn carriage safari and two hours for the guided walking safari, which must be accompanied by a professional guide. Visiting hours are fixed but may be subject to change depending on the number of visitors.

The duration of the visits can be modified from one year to another, according to the needs of the Reserve’s management. The duration of the visit and the corresponding price will always be clearly indicated.

Visitors holding valid entrance tickets have free access to the children’s play areas, the bar and snack bar as well as our responsible Eco Shop.

However, access to accommodations and the natural pool is prohibited.

 

1.3.2: Stays in a standard or upgraded room:

Stays in standard or upgraded rooms include one night with half board.

Rates exclude drinks except those offered by management and mentioned in the reservation contract.

Guests have free access to the children’s play areas, the bar and the snack bar, our responsible Eco Shop, as well as the natural pool.

 

1.3.3: Ecolodge stays:

Ecolodge stays include one-night half-board in the ecolodges as well as a guided walking safari.

We remind you that for the holiday packages, no unused service may be deducted or replaced by another. Rates exclude drinks except those offered by management and mentioned in the reservation.

Guests have free access to the children’s play areas, the bar and the snack bar, our Eco-responsible shop, as well as the natural pool.

 

1.4: Conditions of access to the infrastructure of the Reserve:

In order to guarantee the tranquility of the premises, the animals, and that of our visitors, we inform you that the following are strictly prohibited:

– Picnics. Our reception employee will tell you where to picnic nearby.

– All pets.

 

1.4.1: The natural basin:

Access to the natural pool is authorized from 9 a.m. to 7 p.m.

It is strictly reserved for people staying in the rooms or in the ecolodges and prohibited for any other person.

Children are only allowed if they are accompanied and supervised by an adult who can swim.

Management declines all responsibility in the event of an accident.

 

1.4.2: Playgrounds:

The playgrounds are freely accessible to all visitors holding a valid entry ticket.

Their use is under the supervision and responsibility of the parents or guardian.

1.5 Methods of payment

Individual rates, as well as group rates and ticketing rates, are subject to slight modifications during the season.

La Réserve des Monts d’Azur accepts cards from : the Carte Bleue, Visa, Eurocard / Mastercard networks, bank checks, ANCV holiday vouchers, cash, transfers or administrative money orders.

Cash is only accepted for payments made on site.

The Réserve des Monts d’Azur is not responsible or involved in the event of loss, theft or damage to any personal property deposited on the premises. The clients undertake to respect the safety instructions indicated by the staff of the Reserve or displayed in the enclosure of the Reserve.

 

1.7 Informatique et Libertés

In accordance with Loi 78-17 dite Informatique et Libertés, customers are informed that their order is subject to computerized nominative processing. The right of access and rectification guaranteed by the law is done by the Monts d’Azur Reserve at its headquarters.

 

1.8 Complaints

Complaints that arise during the carrying out of the contract concluded with the SARL Réserve des Monts d’Azur must be submitted as soon as possible on site, in an appropriate manner and with something to serve as proof so that a solution can be sought immediately. Complaints that done on site or that have not been resolved must be sent to SARL RBMA by registered letter within 30 days of the date of the visit that is the subject of the complaint.

 

SPECIAL CONDITIONS

2.1 Preliminary offer

The preliminary offer mentioned in the loi du 13 juillet 1992 consists of the information found on the commercial documentation, on the website www.reserve-biologique.com, as well as through these Conditions of Sale.

 

2.2 Services included in the packages

Only the services explicitly mentioned in the quotes or reservation forms are part of the package.

 

2.3 Booking conditions

 

2.3.1 In the case of ticket orders.

Orders of group tickets benefit from special rates which are applicable only to the category mentioned. The following are affected by this type of rate: Les Comités d’Entreprises

or similar. These rates are applicable to any order of a minimum of 20 tickets (adults).

Tickets are valid for 1 year from the date of purchase and can be used provided a reservation has been made at 09 65 03 49 68.

Tickets will only be sent upon receipt of full payment:

2.3.2 In the case of group visits to the Monts d’Azur Reserve.

Group rates are applicable only to the categories listed.

This rate is for: groups made up of 20 adults or more, schoolchildren, outdoor centers and summer camps, specialized education centers, as long as the booking is on a fixed date and coming to the Monts d’Azur Reserve by the same mode of transport (coach or minibus). Group rates are granted for the reservation and purchase done by one of the individuals of  a collective entry ticket or package.

The contract is concluded when a copy of the contract or the quote is signed within 14 days and returned to the Réserve des Monts d’Azur (or immediately in the event of a reservation less than 31 days before the date chosen) accompanied by a payment of 100% of the amount of the reserved services.

In all cases, the reservation is only confirmed by the Réserve des Monts d’Azur on the day of receipt of the payment indicated on the pro-forma invoice previously established by SARL RBMA.

 

2.3.3 Specific school, town hall, local or territorial authority

The contract is concluded only after the return to the Réserve des Monts d’Azur of an order form, an administrative form or a check corresponding to 50% of the amount indicated on the pro-forma invoice.

 

2.4 Modification of the contract

Any modification of the contract must be the subject of a written request from the customer. In the event of a disagreement, the Réserve des Monts d’Azur reserves the right to cancel the contract and apply the penalties indicated in article 2.6.

The customer must also report, no later than 7 days before the date of the service, any change in the number of customers. Any decrease in the number of participants occurring less than 7 days before the date cannot be taken into account in the billing.

 

2.5 Transfer of contract

The client cannot transfer the contract concluded with the Réserve des Monts d’Azur.

 

2.6 Cancellation at the request of the customer

Any cancellation must be sent to the Réserve des Monts d’Azur by fax or registered letter.

The date of receipt of the fax or mail will be the date retained for the cancellation.

Failure by the customer to respect the schedule will be considered by the Réserve des Monts d’Azur as a cancellation requested by the customer without respecting the formal conditions specified above. The cancellation compensation described below will therefore be retained or deducted.

The amount for cancellation fees is established as follows:

– 50% of the total amount of the reservation for a cancellation contributor

between 15 days and 8 days before the scheduled date of the service,

– 100% of the total amount of the reservation for a cancellation contributor

less than 8 days before the scheduled date of the service,

– 100% of the total amount of the reservation in case of no-show.

 

In the absence of receipt of the payments corresponding to the services reserved within the time limits referred to in the reservation procedures described above, the Réserve des Monts d’Azur reserves the right to consider the customer’s reservation as cancelled and to apply the costs of cancellation above.

Gift vouchers are not affected because special conditions are indicated on each gift voucher issued by the Réserve des Monts d’Azur (cancellation, change or refund not applicable for gift vouchers).

 

2.7 Cancellation at the request of SARL RBMA:

SARL RBMA reserves the right to cancel the service requested when all the conditions favorable to the visit are not met. In this case, SARL RBMA will contact the customer(s) concerned to offer them the possibility of either:

– to postpone the service to a later date convenient to both parties,

– to receive a credit for this same service, valid for one year from the date of its establishment.

 

2.8 Change Insurance

All customers will have the option of signing up for a modification insurance. The amount of said insurance will be proportional to the service concerned. This amount will be indicated precisely, in Euros and including tax, when booking.

In the event that the client chooses a modification insurance, the latter may modify the reserved service in writing, at the latest 12 hours before the date of arrival and free of charge.

The modification will be taken into account but will not give rise to any reimbursement.

The customer may change the date at their convenience or accept a credit note valid for a period of 1 year.

 

2.8.1 Refund

A refund can only be granted by the management of the Monts d’Azur Reserve, on an exceptional basis and extraordinary circumstances.

 

The conditions for requesting reimbursement, see article 2.6.

Extraordinary circumstances or Force majeure mean any event external to the parties that is both unpredictable and insurmountable which prevents either the client, or the travellers, or the agency or the service providers involved in carrying out the trip, from executing all or part of the obligations under the contract.
